The short answer is that minimums exist and many fees follow statutory scales. The long answer is below with concrete numbers you can sanity check.<\/p>\n        <\/section>\n\n        <section id=\"law\">\n          <p class=\"kicker\">Framework<\/p>\n          <h2>What the law now says in plain English<\/h2>\n          <ol>\n            <li><strong>Legal Practitioners Remuneration Order 2023.<\/strong> Sets minimum fees for consultations, incorporations, litigation, and property or land transactions including mortgages and leases. Creates a process when a lawyer intends to charge below the scale and requires written engagement terms within 14 days of instruction.<\/li>\n            <li><strong>Rules of Professional Conduct 2023.<\/strong> Ethics rules on fee arrangements including contingency fees in civil matters, prohibition on bearing a client\u2019s litigation expenses, and the test for reasonable fees.<\/li>\n          <\/ol>\n          <div class=\"box small\">\n            Highlights you will see in invoices include a professional fee that respects the relevant scale, a separate list of disbursements when applicable, VAT at 7.5 percent, and where the payer is a business a likely WHT deduction from the fee.\n          <\/div>\n        <\/section>\n\n        <section id=\"bands\">\n          <p class=\"kicker\">Context<\/p>\n          <h2>State bands and PQE tiers<\/h2>\n          <p>The Order groups states into bands that affect minimums. See worked examples below.<\/p>\n          <\/div>\n        <\/section>\n\n        <section id=\"models\">\n          <p class=\"kicker\">Pricing approaches<\/p>\n          <h2>How lawyers in Nigeria price matters<\/h2>\n          <ul>\n            <li><strong>Scale based.<\/strong> Applies wherever the Order prescribes a minimum for the work type.<\/li>\n            <li><strong>Hourly.<\/strong> The Order sets minimum hourly rates for other commercial transactions.<\/li>\n            <li><strong>Fixed fee.<\/strong> Common for incorporations, routine applications, drafting, or a defined court step. Minimums still apply.<\/li>\n            <li><strong>Contingency or success fee.<\/strong> Available for civil matters only and never for criminal defence. The arrangement must be reasonable and documented.<\/li>\n            <li><strong>Retainers.<\/strong> General or special. The engagement letter should still spell out what tasks are covered and how court attendances will be billed.<\/li>\n          <\/ul>\n        <\/section>\n\n        <section id=\"tax\">\n          <p class=\"kicker\">Taxes you will see<\/p>\n          <h2>VAT and withholding tax<\/h2>\n          <ul>\n            <li><strong>VAT 7.5 percent.<\/strong> Most legal services are taxable supplies so VAT is charged on top of the agreed professional fee.<\/li>\n            <li><strong>Withholding tax on professional fees.<\/strong> Generally 5 percent for resident recipients and 10 percent for non resident recipients under the 2024 Regulations. The payer deducts and remits. For many corporate clients this is standard.<\/li>\n          <\/ul>\n          <p class=\"small\">Practical point. VAT is added on the fee. WHT is deducted from the fee and remitted by the payer. Your invoice usually shows fee, VAT, and the expected WHT deduction.<\/p>\n        <\/section>\n\n        <section id=\"appearance\">\n          <p class=\"kicker\">Court attendances<\/p>\n          <h2>Appearance fees in litigation<\/h2>\n          <p>The Conduct Rules require that where a lawyer accepts a retainer for litigation, the lawyer must be separately instructed and separately remunerated for each piece of work. In practice, this supports a distinct appearance fee per sitting, billed in addition to any filing or preparation fee, and subject to the applicable minimums in the Remuneration Order. Lump sum deals that cover all future appearances irrespective of circumstances are restricted. Document this clearly in the engagement letter.<\/p>\n        <\/section>\n\n        <section id=\"expenses\">\n          <p class=\"kicker\">Out of pocket costs<\/p>\n          <h2>Expenses, disbursements, and interest<\/h2>\n          <ul>\n            <li><strong>What the scale excludes.<\/strong> Stamps, valuers or auctioneers charges, travelling expenses, search fees, fees paid to government on registrations, costs of extracts or certified copies, court filing costs, and similar items are separate disbursements unless the parties agree otherwise.<\/li>\n            <li><strong>Interest and security.<\/strong> A lawyer may charge interest at 10 percent per annum on unpaid disbursements after one month from a written demand. A lawyer may also legitimately request security for disbursements at the outset.<\/li>\n            <li><strong>Who bears expenses.<\/strong> Under the Conduct Rules, the lawyer must not agree to permanently bear a client\u2019s litigation expenses. The lawyer may advance expenses as a matter of convenience but this is subject to reimbursement.<\/li>\n          <\/ul>\n        <\/section>\n\n        <section id=\"examples\">\n          <p class=\"kicker\">Concrete numbers<\/p>\n          <h2>Worked examples<\/h2>\n          <div class=\"box\">\n            <h3>Property purchase for \u20a680,000,000 in Lagos or FCT<\/h3>\n            <p><strong>Conveyance or assignment.<\/strong> Minimum fee for the assignee\u2019s lawyer is \u20a65,000,000 for the first \u20a650,000,000 plus 5 percent of the next \u20a630,000,000 which is \u20a61,500,000. Minimum professional fee is therefore \u20a66,500,000. VAT is added. Search fees, certified copies, valuations, consent fees, and similar items are separate disbursements.<\/p>\n            <ul class=\"small\">\n              <li>Professional fee minimum. \u20a66,500,000<\/li>\n              <li>VAT 7.5 percent. \u20a6487,500<\/li>\n              <li>Subtotal. \u20a66,987,500<\/li>\n              <li>Less WHT 5 percent of fee. \u20a6325,000 withheld and remitted by payer<\/li>\n            <\/ul>\n            <p class=\"small\">Where the same lawyer legitimately represents both sides, total fees must be at least 10 percent of consideration and shared as agreed.<\/p>\n          <\/div>\n          <div class=\"box\" style=\"margin-top:12px\">\n            <h3>Commercial dispute in Band 3 with 10 plus PQE counsel<\/h3>\n            <p>The litigation scale for miscellaneous civil disputes sets a minimum professional fee of \u20a6800,000 for 10 plus PQE counsel in Band 3. VAT is added.
