The <\/span><span style=\"font-size: 12.0pt; line-height: 115%;\">National Lottery (Amendment) Regulations 2007<!-- [if !supportFootnotes]--><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-bidi-theme-font: minor-bidi; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[3]<\/span><!--[endif]--> further stipulated conditions for the registration of a company wishing to undertake lottery business.<\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-family: 'Times New Roman';\">Games of skill relates to games that are played and determined on the players mental or physical skill. It is not left to chance which actually, is a distinguishing factor in the legal implications of both. Game of chance is synonymous to gambling in some countries e.g. Germany thus, can only be carried out in casinos. Examples of games of skill are chess, poker, mahjong or simply use the class of the games which are arcade, puzzle, word, trivia, and card games. Respective laws in Nigeria defines or refer to lotteries to include both game of chance and games of skills<!-- [if !supportFootnotes]--><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[4]<\/span><!--[endif]-->.<\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-family: 'Times New Roman';\">Games of chance are allowed under Nigerian Law<!-- [if !supportFootnotes]--><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[5]<\/span><!--[endif]-->. For the purpose of these questions we will make reference to the National Law<!-- [if !supportFootnotes]--><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[9]<\/span><!--[endif]--> and the laws of Lagos State<!-- [if !supportFootnotes]--><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[10]<\/span><!--[endif]-->. The National Lottery <\/span><span style=\"font-size: 12.0pt; line-height: 115%;\">Regulations<\/span><span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-family: 'Times New Roman';\"> Act merely glosses over the use of the internet or online lottery but makes reference to the use of various online interface<!-- [if !supportFootnotes]--><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[11]<\/span><!--[endif]-->. There is however a link with regards to online lotteries on the website of the <b>National Lottery Regulatory Commission<\/b> (NLRC)<!-- [if !supportFootnotes]--><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[12]<\/span><!--[endif]-->, but the page (internet lottery) is still under construction<!-- [if !supportFootnotes]--><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[13]<\/span><!--[endif]-->. Lagos State has specific provisions governing this<!-- [if !supportFootnotes]--><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[14]<\/span><!--[endif]-->. <\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-family: 'Times New Roman';\">\u00a0<\/span><span style=\"font-size: 12pt;\">Operational licenses are obtained from <\/span><b style=\"font-size: 12pt;\">National Lottery Regulatory Commission <\/b><span style=\"font-size: 12pt;\">in respect of a national license<\/span><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[15]<\/span><span style=\"font-size: 12pt;\">. To operate in Lagos State, also obtain license from <\/span><b style=\"font-size: 12pt;\">Lagos State lottery Board<b><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[16]<\/span><\/b> <\/b><span style=\"font-size: 12pt;\">or licenses from respective states. Lagos has its own lottery board. Lagos State provides for public online lottery and online sport betting.<\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-family: 'Times New Roman';\">\u00a0<\/span><span style=\"font-size: 12pt; line-height: 115%;\">Though the terms and conditions that underlies a game of skill and chance between the players and company<\/span><span style=\"font-size: 12pt; line-height: 115%; color: black;\">\u00a0<\/span><span style=\"font-size: 12pt; line-height: 115%;\">are basically contractual, they have to conform with regulations and laws for instance, under the National Lottery Regulatory Commission<span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[17]<\/span>, they have to be approved by the Commission<span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[18]<\/span>.Terms and conditions are also subject to the approval of licensing the States. The National as well as Lagos State among other things has a minimum age requirement<span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[19]<\/span>. In all instances, terms and conditions should include among other things, the minimum age, and restrictions against certain persons who would be disqualified from participating, (i.e. minors and persons of unsound mind).<\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-family: 'Times New Roman';\">\u00a0<\/span><b><span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-family: 'Times New Roman';\">It should be noted that although o<\/span><\/b><span style=\"font-size: 12pt; line-height: 115%;\">nline adverts <\/span><span style=\"font-size: 12pt; line-height: 115%; color: black;\">of<i> <\/i>game of skill and chance<i> <\/i><\/span><span style=\"font-size: 12pt; line-height: 115%;\">are permissible however, according to sec 2(b) the NLR 2007 Act, adverts must adhere strictly to government policies on social responsibility in designing, advertising and marketing campaign as relates to advertisement. <\/span><span style=\"font-size: 12pt; line-height: 115%;\">It must also conform to the Nigerian Code of Advertising Practice made pursuant to the Advertising Practitioners (Registration etc) Act<span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-bidi-theme-font: minor-bidi; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[20]<\/span>. <b>THE CONSUMER PROTECTION COUNCIL ACT (1992 No. 66) CONSUMER PROTECTION (SALES PROMOTIONS) REGULATIONS 2005<b><span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-bidi-theme-font: minor-bidi; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[21]<\/span><\/b>. <\/b>The <\/span><span style=\"font-size: 12pt; line-height: 115%;\">National Broadcasting Commission Act sec 2 deals with their power to regulate media advertisement.<\/span><\/p><p><span style=\"font-size: 12.0pt; line-height: 115%; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Arial;\">\u00a0<\/span><span style=\"text-align: justify; font-size: 12pt; line-height: 115%;\">The relevant laws that might adversely though remotely affect <\/span><i style=\"text-align: justify;\"><span style=\"font-size: 12.0pt; line-height: 115%; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-fareast-language: EN-GB;\">games of chance and gambling <\/span><\/i><span style=\"text-align: justify; font-size: 12pt; line-height: 115%;\">would be the Criminal Code\/ACJL.<span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[22]<\/span> Chapter 22 of CCA, section 236<span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[23]<\/span> permits game of skill. It provides in s236 (2) that<\/span><span style=\"text-align: justify; font-size: 12pt; line-height: 115%;\">, \u201cunlawful gaming\u201d includes roulette, every game of dice except backgammon, every game of card which is not a game of skill, the game known as chacha and other games of cowries, and any game the chances of which are not alike favorable to all the players, including the banker or other person or persons by whom the game is managed or against whom the other players stake, play or bet.<span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[24]<\/span> Further, section 20 of the <\/span><span style=\"text-align: justify; font-size: 12pt; line-height: 115%;\">National Lottery Regulations 2007 Act prohibits a lottery event in which the winner is chosen on the outcome of a sporting event<span style=\"font-size: 12.0pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: 'Times New Roman'; mso-bidi-theme-font: minor-bidi; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">[25]<\/span>.<\/span><\/p><p style=\"text-align: justify;\"><b><span style=\"font-size: 12.0pt;
